We use ActiveProspect’s TrustedForm Script to independently document users’ consent to be contacted. The TrustedForm Script is embedded on our website and collects the following information when you interact with the page(s) where the script is present: page URL, mouse movements and clicks, contact information inputted by the user, a snapshot of the page, including IP address of the user’s computer, time on the page, date and time that the TrustedForm Script was loaded, as well as the date and time of the various user interactions with the page, and HTTP headers from the user’s browser. ELIGIBILITY
You must be 18 or older to use our Services. Further, no one under age 13 may provide any information to us or via our Services. We do not knowingly collect personal information from children under 13. When you engage our Services, including when you engage with the Site, you may provide certain information to obtain a home improvement or related professional service, which includes the type of service(s) you desire, the location where the service(s) may be provided, and a date when the service(s) is/are needed/to be performed (“Post”).
The information you provide may include Personal Information (defined below) and other information that does not allow us to personally identify you. We may collect Personal Information and other information about you through the Site, Email, SMS, Telephone, WAP, Mobile Application, Mobile Device or other means as discussed in more detail below. We collect and use information you provide or that may be provided to us about you regarding what home improvement or related service you desire, that we may believe is necessary to administer and promote our business, and provide you with the products and services you request. HOW WE COLLECT YOUR INFORMATION
INFORMATION YOU DIRECTLY PROVIDE TO US
You may provide information directly to us under a wide range of circumstances, such as when you submit information to us through the Site; when you sign up to receive email or text messages from us; communicate with us via email; participate in polls or user surveys that may be conducted by us or on our behalf by a third party service providers, including but not limited to questionnaires, interviews, and forums; telephone, text or otherwise request information from us.
In addition, when you reach out to us or access our Site to inquire about a Service, you will have to provide details regarding the type of service you desire, i.e., moving, household maintenance, etc.; the location where the service is required/is to be performed such as the ZIP code; and the date when the service is desired. We do not recommend you share any other Personal Information including but not limited to any financial information in the content you share. We also collect information that you provide as part of your use of the Site (e.g. without limitation, ZIP code, individual preferences, types of services and type of service providers sought) (“Non-Identifying Information”).
INFORMATION WE COLLECT ABOUT YOU ON OUR OWN
There is a lot of non-public information about you. Our employees and agents collect non-public information about you to determine if you might be interested in our Site and/or our Services. This information includes non-public information about you, similar to what you would find in the Yellow Pages, such as, your name, address, and phone number, and can also include information about property transactions that might indicate that you are looking to move or in need of home repair/remodeling services that would be similar to the Services we provide so that we may reach out to your or otherwise advertise our Site or Services to you.

We partner with a number of third parties who may provide us information about you based on information they have collected or received about you that you might be interested in moving, home repair/remodeling, or other services similar to those that we offer so that we may reach out to you or otherwise advertise our Site or Services to you.
INFORMATION AUTOMATICALLY COLLECTED THROUGH THE SITE
Log Data
When you use, interact with our Site or click on a link that directs you to our Site or a function that allows you to submit for our Services, we automatically collect and store, certain information about your device (computer, tablet, smartphone, etc.) and user’s activities, such as:
- Preferences and settings: time zone, language, and character size.
- Identifiers: IP address
- Technical information: type of device, operating system name and version, device manufacturer, browser information (type, version), screen resolution.
- Coarse geographic information: geographic location derived from the IP address.
We collect this data for the proper operation of our Site, including functionality, user-friendliness, and to better tailor our Site to our users’ needs. We also use this information to verify that visitors to the Site meet the criteria required for us to process their requests. While we do not treat Log Data as Personal Information, we may use it in conjunction with or in association with Personal Information, and we may aggregate, analyze, and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.
Traffic Data
Data generated by the use of the Site includes:
- Information about your use of the Site: date stamp, access times and other statistics, URL of the visited page, URL of the last webpage visited before visiting our Site or a website using our Site, URL of the last webpage visited before visiting our Site.
- History of interaction with our webpages: pages viewed, time spent on a page, click through, clickstream data, queries made, search history, search results selected, services you request via the Site, interactions with our third party partners, comments made, type of service requested, purchases made.
We collect this data to understand how our Site is used and to create statistics on the use of our Site. This data is not linked to a specific individual but it enables us to:

Information Collected by Third Party Analytics Services

You also can engage with our Services via social media services or other third party platforms, such as Facebook, Instagram or other third party social media plug-ins, integrations and applications. When you engage with our Services on or through social media services or other third party platforms, plug-ins, integrations or applications, you may allow us to have access to certain Information in a profile you may have with that particular platform, which may include. your name, e-mail address, photo(s), gender, date of birth, location, an ID associated with the applicable third party platform or social media account user files, like photos and videos, your list of friends, connections, people you follow and/or who follow you, or your posts, comments, interactions or “likes.” When we interact with you through our content on third party websites, applications, integrations or platforms, we may obtain any information regarding your interaction with that content, such as content you have viewed and information about advertisements within the content you have been shown or may have clicked on. Third Parties for Analytics
We may share anonymous, non-identifying information with third parties at our discretion and we may otherwise disclose anonymous, non-identifying information and Log Data to third parties for industry analysis, demographic profiling and other purposes.
Service Providers
We may employ third party companies and individuals to provide customer support, research on service providers, facilitate our Site, provide the Site on our behalf, perform Site-related services (e.g. without limitation, maintenance services, database management, web analytics and improvement of the Site’s features) or assist us in analyzing how our Site and Service are used. Law Enforcement/Legal Action
We may disclose your Personal and Non-Personal Information to cooperate with government/law enforcement officials and, if necessary, private parties to enforce and comply with the law, including in order to comply with a subpoena or other court order. Business Transfer
We may sell, assign, transfer or otherwise share some or all of our assets, including your Personal Information, in connection with a merger, acquisition, reorganization, sale of assets or in the event of bankruptcy without any disclosure to you or consent from you. In the event of our bankruptcy, reorganization, or receivership, or the application of laws affecting creditors' rights, this Privacy Policy may not be applicable and we may not be able to control how your Personal Information is transferred, or used. In such a case, we reserve the right to transfer Personal Information that we have collected from you to third parties.
DO NOT TRACK
Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. At this time, we do not respond to Web browser “do not track” settings or signals. We deploy cookies and other technologies on our Service to collect information about you and your browsing activity, even if you have turned on the Do Not Track signal.
COMMUNICATIONS TO USERS / CAN-SPAM
Unless we are prohibited by applicable law from using cookies and a user has not otherwise opted out or disabled our use of Log or Traffic Data that comes to us in the form of first- or third-party cookies, we insert cookies in some of our correspondence with users. In that case, when we send an email message to a user, our message contains images or links, which when viewed or clicked, will register an event with us that allows us to know whether the user has accessed or declined to open our message. This action may also store a cookie which will allow us to count unique clicks or visits and potentially track the recipient.
This information is needed for our legitimate business purposes, because it helps us understand how the individual reacts to our communications and limit the amount and nature of information provided. The information is collected in connection with our marketing efforts and is retained so that we can continue or elect to stop interaction with the lead.

Under the CCPA, a “sale” means providing to a third party personal information for valuable consideration. It does not necessarily mean money was exchanged for the transfer of personal information. We have taken substantial steps to identify whether any of our data sharing arrangements would constitute a “sale” under the CCPA. Due to the complexities and ambiguities in the CCPA, we will continue to evaluate some of our third party relationships as we wait for final implementing regulations and guidance. For example, it is currently unclear whether the use of certain types of advertising partners would be considered a sale under CCPA. We provide Usage Data to advertising partners, which enables us to provide you with interest-based advertising. Your Rights and Choices
Under California Laws, California residents can exercise three privacy rights (Disclosure and Access; Deletion; and “Do Not Sell My Personal Information”), which are described in more detail below (collectively, “Rights”). These Rights are not absolute and are subject to certain exceptions. For instance, we cannot disclose or permit access to specific pieces of personal information if the disclosure or access would present a certain level of risk to the security of the personal information, your account with us or the security of the business’s systems of networks. If you are a California consumer, we will process your request to exercise your Rights in accordance with California Laws.
A record concerning the requests may be maintained pursuant to our legal obligations. Further, we may charge a reasonable fee or refuse to act on a request if such request is excessive, repetitive or manifestly unfounded.
Disclosure and Access Requests
You have the right to request that we disclose to you, for the 12-month period immediately preceding the date of your request to know the following:
Categories of Personal Information Request
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting or selling that personal information.
- The categories of third parties with whom we share that personal information.
- If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Specific Pieces of Information Request
- The specific pieces of personal information we collected about you (also called a data portability request).
When a request for disclosure is made, we will first take steps to verify your identity to protect your privacy and security. For requests to disclose categories of personal information collected, we will have the requestor provide at least two pieces of information so that we may verify the requestor’s identity to a reasonable degree of certainty. For requests to disclose specific pieces of personal information collected, we will have the requestor provider at least three pieces of information so that we may verify the requestor’s identity to a reasonably high degree of certainty and additionally provide a signed declaration under penalty of perjury that the requestor is the consumer whose personal information is the subject of the request. We are required to retain the signed declarations as part of our record-keeping obligations for 24 months.
Please note that we will never disclose a consumer’s social security number, driver’s license number, or other government-issued identification number, financial account number, any health information or medical identification number, an account password, or security questions and answers in response to a disclosure request.
Please note additionally that we are only required to fulfil a Disclosure request from a consumer twice per every 12-month period. If you submit a request in excess, it may be denied or you may be charged for fulfilling your request.
Deletion Request Rights
You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Given the type of Personal Information we collect, for requests to delete personal information collected, we will have the requestor provide at least three pieces of information so that we may verify the requestor’s identity to a reasonably high degree of certainty. We are required to retain the requests to delete for a period of 12 months as part of our record-keeping obligations.
If we are unable to verify a request, to the extent possible, that request will be treated as a request to opt-out and afforded rights associated with that request right as described in more detail below.
Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. A deletion request may be denied, in full or in part, if retaining the information is necessary for us or our service providers to:
- Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Disclosure and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
Household Requests
We currently do not collect household data. If all the members of a household makes a Right to Know or Right to Delete request, we will respond as if the requests are individual requests.
Do Not Sell My Personal Information Requests
You have the right to direct us not to sell your personal information to a third party. To request that we not sell your personal information, click the button “Do Not Sell My Personal Information.”
Requests Made Through Agents
You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us. (The verification requirement does not apply if the consumer has provided the authorized agent with legal power of attorney under California Probate Code Sections 400 to 4465.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data disclosure requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Requests to Opt-In for Minors
If you are 16 years of age or older, you have the right to direct us not to sell your personal information at any time. We do not and will not sell personal information of consumers we actually know are less than 16 years of age unless we received affirmative authorization from the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age, to opt-in to the sale of their personal information. Upon the receipt of this request to opt-in, we will inform the minor of the right to opt-out later and of the process for doing so.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Nevada Privacy Rights
As of October 1, 2019, if you are a Nevada resident, you may opt-out of the sale of your Personal Information. To do so, please contact us at 855-224-5599 or via email privacy@billy.com and title the subject of your email “Nevada Privacy Rights Opt-Out Request”. In response, we will request information from you to verify your identity. We will respond to your request, once verified, within 60 calendar days (with a possible 30 day extension upon notice to you).
MOBILE SERVICES AND TEXT TERMS
The Site and Services may include certain features or services that are available via your mobile phone (the “Mobile Services”), such as the ability to upload content to your mobile phone or request status messages or other alerts be sent to your mobile phone. You may also be called by one of our Service Provider and your providing us your telephone number, including your mobile number, constitute consent for contact, even if you are on the Do Not Call registry. In addition, if you are required to provide a phone number as part of the account registration process and online order process as part of your contact information, you have the option, but are not required, to provide your mobile number as your contact number. However, by using the Site or Service, or by providing your mobile number as a contact point, you consent to receive MMS, text message or other electronic means (collectively “Text Messages”), including auto dialers, to your mobile device and that certain information about your usage of the Mobile Services may be communicated to us. Your consent to receive Text Messages from us. You will receive opt-in and confirmatory text messages from us. You also agree to receive confirmation opt-out texts from us.
You understand that you are responsible for securing the necessary data access service and that your carrier’s normal messaging, data and other rates and fees will apply to these Mobile Services and other communications. Please consult your service agreement with your wireless carrier to determine your phone’s pricing plan.
Please note that if you are using downloadable applications from us, updates to your device’s systems or firmware may render your use of the applications incompatible. We do not warrant that the Online Services will be compatible with any updates to, or prior versions of, your devices. We may, but are not obligated to, provide you with updates to the Online Services or applications that improve compatibility with updated mobile devices. This program may not be available on all wireless carriers.
MISCELLANEOUS
International Information Processing & Transfer
Your information may be processed, updated, transferred, stored, and maintained on computer hardware and computer software at third-party locations outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Billy.com transfers Personal Information to the United States and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
Security
The security of your Personal Information is important to us. We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. We are not responsible for circumvention of any privacy settings or security measures contained on the Online Services.
Further, our Services may offer opportunities to communicate through email, SMS or text messages. Because normal email is not encrypted, the possibility exists that unauthorized individuals may intercept email messages. Neither we nor any of our third party business partners are not responsible for the privacy and security of email messages except those stored in our system.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a verification information for access to certain parts of our Site or Services, you are responsible for keeping this information confidential. We urge you to take steps to keep your private information secure, such as choosing unique verification information and never sharing such information with anyone else. We urge you to be careful about giving out information in public areas of the Site. The information you share in public areas may be viewed by any user of the Site. Please notify us promptly if you believe your verification information or identify has been breached.
Data Retention
We will retain your information whether Personal Information or Non-Identifying Information for as long as reasonably needed to provide you with the services you request via the Site.
Changes to Privacy Policy
We may update this Privacy Policy at any time through a notice on this Site prior to the changes becoming effective or we will notify you by email (sent to the e-mail address specified in your account).
